The Workplace Relations Commission found that a gym coordinator was constructively dismissed and awarded her €1,250. Adjudication Officer Eugene Hanly dated the decision 25 October 2017. The coordinator said public transport could not get her to the proposed branch for a 6am start. The gym relied on a transfer clause in her contract and said the early start was a scheduling error, offering a 7am start. The adjudicator found that the transfer was poorly handled and that the gym acted unreasonably by insisting on early starts despite her transport difficulties. He also found that she acted hastily and contributed substantially to the dismissal, which affected the compensation. The WRC also awarded her €432.69 in minimum notice pay. The adjudicator found that a roster error meant she could not work her notice at the new branch, after she had offered to work it at her original location.
