The WRC awarded a shop assistant €16,000 after finding that a pharmacy discriminated against her because of her disability when it dismissed her. The decision was dated 4 October 2017. The adjudicator found the pharmacy had considered her counter assistant role unsuitable because of her disability, without seeking a professional medical opinion or consulting her about her ability to do the work.
The shop assistant said she was told the job was unsuitable because of her disability. The pharmacy said it had intended to discuss her condition and possible accommodations, but that she left before the discussion could continue. The WRC found discrimination and awarded compensation equivalent to approximately one year’s salary. She had about 16 months remaining on her fixed-term contract when she was dismissed.
