WRC awards kitchen designer €12,480 for unfair dismissal

Workplace Relations Commission ·

The Workplace Relations Commission (WRC) awarded a kitchen designer €12,480 for unfair dismissal and €1,040 for the company’s failure to give her two weeks’ notice. The decision was dated 15 February 2018.

The Interior Design Company said she resigned during a meeting while on sick leave. The WRC found she had been dismissed: her store keys were requested, her work email access was blocked and a replacement had applied for the job before the meeting. It also found the company had no evidence to justify the dismissal and had not followed a fair process.

The company did not give her time to clarify whether she intended to resign, although it knew she was distressed and unwell. The WRC found she had more than two years’ service and was entitled to two weeks’ notice. It directed the company to pay the notice compensation, subject to lawful deductions.
