WRC rejects clerical officer’s wage and constructive-dismissal complaints

By Tadhg O'Sullivan

Workplace Relations Commission ·

The Workplace Relations Commission rejected a clerical officer’s complaints about wage deductions and constructive dismissal, and found her penalisation complaint was out of time and not well founded. The decision was dated 12 September 2017.

The officer found the respondent had applied its sick-pay policy and that the complainant had not established a contractual entitlement to the extra wages she sought. Her constructive-dismissal claims failed because she had not shown she was entitled to resign, after the respondent investigated and reviewed her grievance. The earlier holiday and hours claims were out of time. She withdrew her Employment Equality Act complaint.
