WRC awards retail assistant €3,200 for unfair dismissal

Workplace Relations Commission ·

A retail assistant won her unfair-dismissal complaint against a retail store, which the WRC required to pay her €3,200. Adjudication Officer Gaye Cunningham dated the decision 16 November 2017. The assistant said management had allowed her to work 10 hours a week while she attended a training course, then told her she had to return to her contracted 20-to-25 hours. The store said business needs required her contracted hours and argued that she had resigned. Cunningham found there was no written resignation and concluded the store ended the employment when the assistant could not work the required hours. She found the dismissal unfair. Reinstatement or re-engagement was unsuitable because the same difficulties might recur.
