Hotel must pay assistant €15,000 for pregnancy discrimination

Workplace Relations Commission ·

The Workplace Relations Commission awarded a hotel assistant €15,000 after finding the hotel discriminated against her because of her pregnancy. The decision was dated 11 December 2017.

The assistant said the hotel moved her from café duties to physically demanding wedding setup work after she disclosed her pregnancy. The WRC found the duties changed because she was pregnant and the hotel had not assessed the risks of those tasks. It also found the hotel failed to properly assess risks after her illness or give her a fair opportunity to return to work.

The hotel said staff routinely moved between roles and it had concerns about her fitness to work. The WRC rejected her claim about discriminatory working hours after her return, finding she had requested a maximum 19-hour week and could not work weekends.
