WRC rejects employee’s constructive dismissal and redundancy claims

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission rejected an employee’s constructive dismissal and redundancy claims against a car rental company. The decision was dated 16 November 2017. The employee said unsafe shifts, pay concerns and the refusal of a reduced working week led him to resign. The company’s manager said part-time hours were unavailable and offered alternating early and late shifts. The adjudication officer found the employee had warned the manager he might leave, but had not shown that his working conditions were untenable. The officer considered the shift option reasonable and noted that the employee did not try it. The redundancy claim failed because the employee accepted there was no redundancy situation.
