The WRC awarded a cleaner €12,825.80 after finding that a bus/coach company unfairly dismissed him. Adjudication Officer Roger McGrath dated the decision 21 November 2017.
The company said the cleaner had damaged a bus and failed to report it, and that an existing final warning justified dismissal. The cleaner disputed that he had been trained to drive or told to report damage. The officer found the company had not shown that the reporting rule was communicated or that adequate driving training was given. The dismissal was also procedurally unfair: the cleaner saw CCTV only at the disciplinary hearing and was not told dismissal was a possible sanction. The officer found his efforts to reduce his losses could have been better.
