WRC awards accounts manager €15,000 after constructive dismissal finding

Workplace Relations Commission ·

The Workplace Relations Commission awarded an accounts manager €15,000 after finding she was constructively dismissed following repeated shouting and abusive behaviour by a company director. The decision was dated 5 April 2018.

The WRC also awarded her €1,197.67 in unpaid wages, €128.81 in holiday pay and €1,527 under her terms-of-employment complaint. All three complaints succeeded.

She said the director’s conduct made it impossible to continue working there. The company did not attend the hearing, leaving her evidence uncontested. The adjudication officer found her credible and said the other director’s reaction tended to corroborate her account.

The officer found the director’s conduct extreme and said its effect meant she could not reasonably be expected to put up with it. Although she had not used the formal grievance procedure, she had raised the issue with another director, and the officer found that step sufficient in the circumstances. The awards were subject to normal statutory deductions.
