The WRC recommended that an employer offer an executive engineer a contract of indefinite duration after she had worked for ten years on a specified-purpose contract. The recommendation was dated 4 January 2018.
The complainant argued that there was no justification for keeping her on temporary terms for so long. The employer said the dispute belonged under the Protection of Employees (Fixed Term Work) Act 2003, and cited the recruitment moratorium and its practice of filling permanent posts through competition.
Adjudication Officer Michael Hayes described the circumstances as “extremely unusual”. He recommended that the employer offer the complainant a contract of indefinite duration from a current date, without precedent.
