The WRC awarded a worker €15,000 after finding her dismissal by a retail company unfair. Adjudication Officer Niamh O’Carroll Kelly dated the decision 9 November 2017.
The worker had mistakenly sent financial information to the wrong accounting firm. The company accepted that the error was not deliberate, but dismissed her without an investigation, disciplinary hearing or appeal. The WRC found the company had not established what information was sent or how sensitive it was, leaving the worker unable to answer the allegation. It also found the dismissal disproportionate, as other work within the company could have been considered.
