The Workplace Relations Commission found a senior staff nurse’s claim for retrospective pay was not well founded in a recommendation dated 29 September 2017. The nurse said she should have moved to the senior staff nurse pay scale in 2008, but was placed on it from October 2013 and sought backdated pay. The health sector employer said appointments required an application, which she did not make until November 2014, and that a circular governed appointments after a recruitment moratorium. The WRC found that she was already in post before the moratorium and that both her union and the employer had alerted staff to the application process. It concluded that the terms of circular 17/2013 applied, and the claim failed.
