WRC awards standards officer €984.23 over unlawful pay deductions

By Rory Hanlon

Workplace Relations Commission ·

The Workplace Relations Commission awarded a standards officer €984.23 after finding his employer unlawfully deducted part of his pay while delaying his return to work. The decision was dated 16 June 2017.

The officer said he was no longer sick and wanted to return to work from 19 September 2016, but his return was delayed while the employer considered medical advice and required reassessment. The employer said he had not provided a fitness certificate and continued to seek a change in reporting structure. The WRC found the relocation request had been refused on 19 September and the employer had an obligation to get him back to work as quickly as possible. It found the deductions from his full salary for the final month of absence were unlawful.
