The WRC awarded €17,500 to a worker unfairly dismissed by a manufacturing plant and upheld his separate minimum notice complaint. The decision was dated 1 November 2017.
The worker said the disciplinary process was flawed and dismissal disproportionate. The company said he breached sick leave procedures by failing to disclose planned treatment abroad and refusing management instructions. The adjudicator found serious procedural failures, including an unjustified unpaid suspension and no evidence that alternatives to dismissal had been considered. She also found that the worker breached sick leave procedures and contributed significantly to his dismissal. The company was required to pay six weeks’ notice under the separate complaint.
