The WRC awarded a service station worker €7,020 after finding she was unfairly dismissed for making a protected disclosure. The decision was dated 21 September 2017.
The worker said she raised concerns about money held in the safe and ATM and alleged that stocktake figures had been falsified. The employer argued her performance was unsatisfactory and denied a link between the disclosure and her dismissal. The adjudication officer noted positive appraisals, including one four days before her employment ended, and said the manager had not given compelling evidence to explain the gap between those appraisals and his criticism of her performance. The officer found, on the balance of probabilities, that the dismissal was wholly or mainly related to the protected disclosure.
