The Workplace Relations Commission found a café manager was entitled to a redundancy payment of €6,020.96 and €2,000 compensation for unpaid annual leave in a decision dated 11 August 2017. It also required her former employer to pay 13.3 days’ leave, based on gross weekly pay of €484. The manager said she remained employed while running the business and was told there was no work for her when it closed in November 2016. The employer argued that the business had transferred to her months earlier and that it had no further responsibility for her employment or leave. The WRC found she remained an employee until the business ceased and was made redundant. It found she was entitled to eight months’ annual leave from April to November 2016, and required payment for 13.3 days as well as compensation for the breach.
