The Workplace Relations Commission found that a manager was entitled to a redundancy lump sum after her employment ended when a public house closed on 30 June 2016. The decision was dated 12 June 2017. The entitlement is subject to the statutory wage ceiling of €600 per week and the conditions set out in the decision.
The respondent argued that the manager’s employment had transferred to a new business. The adjudication officer found the respondent had not provided the required written terms for a transfer and there was insufficient evidence of an offer of re-engagement or the manager’s agreement. The officer accepted that she had not worked for the prospective purchasers or the landlord and found that her employment ended when the respondent’s business closed.
