The Workplace Relations Commission found that a civil servant’s complaint of penalisation under the Protected Disclosures Act was not well founded. The decision, dated 28 November 2017, concerned Mr. A (1), who said a government department had penalised him for a protected disclosure about a public body’s inspectorate. The department denied the claim.

Adjudication Officer Kevin Baneham found that events within the time limit, including the handling of the complainant’s return from sick leave and his application to remain in civil service employment after retirement age, were not shown to have been caused by the disclosure. The complaint failed.
