The WRC found it had no jurisdiction over Mr A’s complaint that a public body penalised him for making protected disclosures. The decision was dated 28 November 2017.

The adjudicator found that Mr A was a civil servant employed by the parent Government Department, although he was a worker supplied to the public body. The WRC complaint route under the Protected Disclosures Act applied to employees; the merits of the alleged penalisation were not decided. Mr A said his treatment after making disclosures amounted to penalisation, while the public body denied the claim.
