Service engineer’s overtime claim fails; WRC declines jurisdiction over dispute

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission found that a service engineer’s overtime claim against a plant machinery provider did not succeed. Adjudication officer Kevin Baneham dated the decision 29 August 2017. The officer said the employment terms required authorised overtime, and the worker had not established that the claimed pay was owing. The worker estimated he was owed €560–€600 for evening overtime. The company denied authorising it and said he generally worked only a few minutes beyond 5.30pm. The WRC also found it had no jurisdiction over the related Industrial Relations dispute after the company objected; the merits of that dispute were not decided.
