WRC directs bakery to re-engage operative after unfair dismissal

By Eimear Byrne

Workplace Relations Commission ·

The WRC found a bakery operative was unfairly dismissed and directed the bakery to re-engage the worker from 1 October 2017. Adjudication officer Michael McEntee dated the decision 21 September 2017. The dismissal followed clocking-system incidents on one day after 16 years’ service. The WRC found the investigation was thorough but said the bakery should have made greater efforts to ensure the worker had adequate representation. It found the incidents did not show major dishonesty and that dismissal was disproportionate. The period from dismissal until re-engagement was to count as unpaid suspension, and the WRC said no notice payment was warranted.
