The WRC found three complaints by a car park operative against a car park operator not well founded. The decision was dated 21 September 2017. The operative said his employment ended on 14 November 2016 after the operator’s contract to run the car park ended, and that his contract and employment should have transferred. The operator said it believed a transfer applied; the car park owner argued the rules did not apply. The officer concluded that no transfer of undertaking occurred: there had been no transfer of assets or staff, and the previous contract holder continued to exist. The complaints therefore failed.
