WRC rejects general operative’s unfair dismissal complaint

By Saoirse Doyle

Workplace Relations Commission ·

The WRC rejected a general operative’s unfair dismissal complaint against a manufacturing company in a decision dated 29 August 2017. The officer found a flaw in how the worker could challenge evidence about an allegation of sleeping at work, but concluded that the separate safety breach finding and dismissal process were fair. The company said the worker had failed to isolate equipment and complete a risk assessment, and had been found sleeping at work. The officer said the WRC’s task was to assess whether the dismissal process was fair, not decide guilt or innocence.
