The Workplace Relations Commission found a quantity surveyor’s constructive dismissal and redundancy complaints against a construction firm were not well founded. The decision was dated 20 March 2018. The worker resigned after the firm asked him to travel to a UK project. The adjudication officer found the assignment did not amount to a fundamental breach of his contract, and the firm had not begun disciplinary proceedings. He also found the worker had not used internal procedures before resigning. The redundancy complaint also failed. Although several projects were ending, the firm had secured new Irish work and had tried to replace him, eventually hiring a less experienced quantity surveyor. The officer found there was no redundancy situation.
