The Workplace Relations Commission found that a car park operative was made redundant and ordered the car park operator to pay him €1,890.48 for minimum notice. The decision was dated 31 August 2017. The operative was also entitled to a redundancy lump sum based on his service and gross weekly pay of €472.62, subject to the statutory insurable employment condition. The officer dismissed the unfair dismissal complaint. The operator argued that the job transferred to the car park’s new owner, but the officer found the transfer regulations did not apply. The operative’s employment therefore remained with the operator. The officer found that alternative jobs in Dublin, more than 150 kilometres away, were not suitable alternatives.
