The Workplace Relations Commission found a bar tender’s unfair dismissal complaint not well founded, ruling that no dismissal had taken place. Adjudication Officer Michael Hayes dated the decision 14 June 2017. A separate Payment of Wages complaint had been settled before the hearing. The bar tender said he was given the choice to resign immediately or face an investigation, and signed a resignation letter without time to consider it. The bar said he chose to resign after being shown evidence of unregistered drinks sales and advised of his rights. The WRC found that the lack of a cooling-off period did not make it impossible for him to remain employed. It also noted that he could have withdrawn his resignation within a reasonable period but did not.
