The Workplace Relations Commission awarded a warehouse manager €33,200 for unfair dismissal and directed a separate €7,138 payment for minimum notice. Adjudication Officer Kevin Baneham dated the decision 30 November 2017.
A logistics company said it dismissed him for gross misconduct after he allegedly tried to persuade a colleague to change her account of a workplace incident. He denied this. The WRC did not decide which account was true, but found the company had not reasonably investigated the conflicting evidence. It relied on an earlier, unrelated conversation and did not interview other potential witnesses. The manager had 18 years’ service and found work after 26 weeks. The WRC awarded €23,200 for that period’s financial loss and €10,000 for ongoing salary loss. It also found that he was entitled to eight weeks’ statutory notice because the company had not shown misconduct that removed that entitlement.
