The Workplace Relations Commission found five general operatives’ complaints about night shift pay well founded. Each was entitled to 32 cent gross for every night shift hour worked during the complaint period, less statutory deductions. The decision was dated 16 November 2017. The workers said their night shift rate was linked to the industry minimum rate. After the rate rose from €9.50 to €9.75 in October 2015, their night shift rate did not increase. The adjudicator found the link was an implied contractual term that existed before their contracts transferred to the facilities services provider in March 2015.
