A catering company was found not to have discriminated against, discriminatorily dismissed, victimised or victimisatorily dismissed a worker on civil status, family status, race, religion or Traveller community grounds. The WRC dated its decision 24 August 2017.
The worker said he had applied unsuccessfully seven times for team leader and complained that a manager touched his hand while stopping him from carrying out a task. The company said completing an online training course was required for promotion and that it dismissed him after unauthorised absence and disciplinary proceedings.
The adjudication officer found no evidence linking the unsuccessful promotion applications or employment conditions to discriminatory grounds. The hand touch did not establish harassment related to a protected ground. The worker also did not substantiate a link between a Facebook post, a changed roster and adverse treatment, or show that his dismissal was connected to a protected act.
