The Workplace Relations Commission awarded a driver €7,500 after finding his dismissal unfair. Adjudication Officer Eugene Hanly dated the decision 9 March 2018. The employer, described in the case listing as Municipal Services, said the driver had repeated misconduct, including unauthorised dumping, and that dismissal was justified. The driver disputed some allegations and said the employer had not investigated them or given him a disciplinary hearing, a chance to respond or an appeal. The officer found that the employer had failed to properly investigate the alleged misconduct and had denied the driver a chance to defend himself, representation and an appeal. The dismissal was both substantively and procedurally unfair. The officer also found that the driver contributed to his dismissal, and the €7,500 compensation reflected that contribution.
