The Workplace Relations Commission rejected Helena O’Neill’s complaints of constructive dismissal and breaches of maternity protection rights, and found no discrimination on gender or family status grounds. The decision was dated 11 July 2018. The WRC found O’Neill resigned two days after her first meeting with the person appointed to investigate her complaint, leaving Westwood Club Limited no proper opportunity to investigate or complete its grievance process. It also found she returned from maternity leave to the same work, place and pay. Westwood Club Limited denied the complaints. Her victimisation complaint was not pursued at the hearing.
