WRC awards care worker €8,000 after unfair dismissal

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission found that a care worker was unfairly dismissed by a nursing home and awarded her €8,000 compensation. The decision was dated 11 July 2017. The home said it dismissed her after a colleague complained about her treatment of a resident. The worker denied the allegations and argued that the home had decided she was guilty before giving her a fair chance to respond. The officer found that the worker was denied a fair process from the outset and was put off duty without an opportunity to defend herself. The invitation to the disciplinary hearing suggested a guilty verdict had already been reached. The home had failed to follow most of its elder-abuse policy, and the officer did not find credible its claim that alternatives to dismissal had been considered.
