WRC awards book keeper €11,250 after finding dismissal unfair

Workplace Relations Commission ·

The Workplace Relations Commission awarded €11,250 to a book keeper after finding her dismissal unfair. The decision was dated 24 August 2017.

The letting agency said the employment ended by mutual agreement after concerns about her work, including its procedures for refunding tenant deposits. The book keeper said she did not consent to the termination and had received no notice or fair process.

The adjudication officer found that the agency had not shown substantial grounds for dismissal or a fair process. The evidence did not establish that earlier meetings related to her performance or that an oral warning had been given. The officer considered the performance concerns credible but said they should have been addressed in the workplace; without a fair process, they did not reduce the award.
