The WRC upheld a construction operative’s redundancy complaint after finding that a job in Athlone, with reduced travel payments, was not suitable alternative employment. The decision was dated 20 December 2017. The worker said he had received a €150 weekly travel allowance on an earlier project and that the Athlone job was farther from home. The construction firm said the allowance applied only to that project, offered €100 a week for travel to Athlone and argued that the worker ended his employment after declining the offer. The adjudication officer accepted that the earlier allowance was project-specific but found the worker had not been told why it was paid, so his expectation that it would continue was not unreasonable. The officer found the Athlone job differed significantly and detrimentally from his previous terms and directed the firm to pay statutory redundancy within 42 days.
