The WRC did not uphold an employee’s redundancy complaint against a licensed premises in a decision dated 5 April 2017. The officer found the new owner offered the worker employment on her previous terms and conditions after taking over the premises. The worker said the previous owner had gone into liquidation and had not paid redundancy. The new owner said he accepted transfer of undertaking responsibilities and offered the existing staff alternative work during the gap before reopening. The officer found the worker chose to decline the offer, leaving no basis for the redundancy claim.
