The WRC awarded a cleaner €630 compensation after finding his employer had breached his transferred contract by failing to offer the required peak-week hours. A separate Payment of Wages complaint was not well founded. The decision was dated 3 May 2017. The cleaner said his contract provided for 30 to 37.5 hours in peak weeks, but he was told he was entitled to four hours and received only 16 hours in one peak week. The employer said he worked relief shifts, was contracted for four hours a week and had been offered additional shifts. The adjudication officer found the signed contract required the employer to offer the stated peak-week hours. The €630 compensation included the net pay value of the unallocated hours. The Payment of Wages complaint failed because the alleged deduction occurred after it was submitted.
