The WRC ordered an employer to pay a cleaner €750 compensation after finding it breached her transferred sick-pay terms. It also ordered €213.40 net compensation for an unlawful deduction. The cleaner said her contract entitled her to two weeks’ sick pay after a workplace injury, but the employer refused payment, saying sick pay was discretionary under its policy. Adjudication Officer Michael Hayes, in a decision dated 3 May 2017, found the employer had not given objective reasons for withholding the contractual entitlement. The €750 compensation was separate from the unpaid sick pay.
