The WRC dismissed a cleaning supervisor’s complaint against a contract cleaning company after finding that no transfer of an undertaking had taken place. The decision was dated 21 July 2017. The supervisor said she was told she would transfer to the replacement contractor, but later learned that staff would not be taken on. The company said the new contract involved fewer cleaning hours and it had no role for a supervisor who did not do cleaning work. The adjudication officer found that no assets or employees had transferred, and that the loss of a smaller service contract to a competitor did not by itself establish a transfer under the regulations.
