WRC awards dental nurse €3,500 over transfer-related dismissal

By Gráinne Nolan

Workplace Relations Commission ·

The WRC awarded a dental nurse €3,500 after finding her dismissal breached protections for workers when a business transfers to a new owner. The decision was dated 20 December 2017. The worker said she had been told her job was safe after her employer died, but the successor later said her contract would not be renewed. She said the practice continued with the same patient list and contact details. The dental surgeon did not attend the hearing. A representative said the former employer’s widow had made the worker redundant after the successor said he could not take on two employees. The adjudication officer found that the business transfer constituted grounds for dismissal in breach of Regulation 5. The WRC upheld the complaint and ordered the respondent to pay €3,500 compensation within 42 days.
