Mechanic’s unfair dismissal complaint fails after he waited 18 months to resign

Workplace Relations Commission ·

The WRC rejected a mechanic’s unfair dismissal complaint against a motor trade wholesaler, finding that his 2016 resignation did not meet the test for constructive dismissal. The decision was dated 11 July 2017. The mechanic had grievances about his duties and pay, including missing payslips and a €50 weekly pay reduction without a written agreement. The WRC accepted those concerns but noted that the final correspondence about resolving them was in February 2015, at least 18 months before he resigned. It found the evidence did not show that he had no reasonable option but to leave.
