The Workplace Relations Commission awarded a cleaning operative €1,150 after finding that no transfer of undertakings took place when a school cleaning contract changed hands. The decision was dated 2 March 2017. The worker said the incoming contractor told her she was not its employee, although the outgoing company had told her that her service had transferred. The outgoing company argued there had been a valid transfer and that liabilities had passed to the new contractor. The adjudication officer found there had been no transfer of significant assets or a major part of the workforce. He awarded €1,150 under the transfer regulations, equivalent to seven weeks’ gross pay. He made no award for the late notice of the contract change, accepting the respondent’s good faith on that issue.
