WRC finds medical device worker’s repeated protocol breaches justified dismissal

By Cathal Brosnan

Workplace Relations Commission ·

The WRC found that a general operative’s unfair dismissal complaint was not well founded, ruling that his dismissal was proportionate after repeated breaches of manufacturing protocols. Adjudication Officer Patsy Doyle dated the decision 20 July 2017.

The medical device company said the worker backdated records and mishandled products placed on hold, threatening the integrity of its regulated manufacturing process. He argued that his training in the new department was incomplete and that dismissal was too severe given his long service and work record.

The WRC accepted that the company had provided training and an opportunity to improve after the first incident. It found that the repeated breaches affected trust and product integrity, and that dismissal was proportionate to the misconduct.
