School secretary awarded €6,525 after unfair dismissal

By Tadhg O'Sullivan

Workplace Relations Commission ·

The WRC found that a school secretary was unfairly dismissed by a national school and awarded her €6,525 in compensation. Adjudication Officer Gerry Rooney dated the decision 29 August 2017. The officer found that the school had not fairly investigated concerns about the secretary’s performance and a social media post. The school said the dismissal followed serious shortcomings in her duties and that the post damaged its reputation. The secretary argued that the dismissal was disproportionate and procedures were unfair. The appeal process was flawed because board members involved in the disciplinary process also considered her appeal. The officer found the dismissal disproportionate given her service, the absence of a social media policy and prior formal performance concerns. The award reflected her actual loss after she found alternative work.
