WRC grants technician four months’ paid sick leave after finding company acted arbitrarily

By Saoirse Doyle

Workplace Relations Commission ·

The Workplace Relations Commission ordered a food company to provide a maintenance technician with four months’ paid sick leave, less social welfare payments, after finding it exercised its discretion arbitrarily. The decision was dated 15 February 2017.

The technician had been on unpaid sick leave after an accident at work. He said the company had paid employees in similar circumstances before. The company denied any contractual right to paid sick leave, but the adjudication officer found the contract and handbook allowed management discretion and that the company had not considered his application individually.
