The Workplace Relations Commission dismissed all complaints against the respondent in ADJ-00004630 after finding it was not the worker’s employer. The decision was dated 12 April 2017. The worker had complained about Sunday premiums, holiday pay, written employment terms, working hours and other entitlements. The respondent said the worker’s employment had transferred to the employer named in a related case, ADJ-00003068. A transfer letter said the move took effect on 30 June 2014, with her terms, continuity of employment and accrued rights retained. The worker’s representative accepted the clarification about the correct employer. The WRC dismissed the complaints on that basis; the merits were not decided.
