The WRC found that a property and data services company breached transfer of undertakings rules by failing to honour a project manager’s signed €53,000 annual salary agreement. The decision was dated 5 July 2017 and awarded him €2,000 compensation, with any salary arrears due within six weeks. The company said the salary figure was a mistake and offered €47,500. The WRC found that its due diligence had not established the employee’s full remuneration package and that the signed agreement should have been honoured. His Payment of Wages complaint was withdrawn. His constructive dismissal complaint failed because he resigned before the grievance investigation concluded and had not exhausted the procedure.
