Building worker awarded €3,250 for unfair dismissal

By Fionn Kelly

Workplace Relations Commission ·

The WRC found that a building worker was unfairly dismissed and awarded him €3,250. It also upheld his complaints about missing written terms, minimum notice and holiday pay, awarding €100, €535 and €1,500 respectively. Adjudication Officer Michael McEntee dated the decision 30 August 2017. The building company said work had ended after its tools were stolen and it could no longer offer work to a casual employee without his own tools. The worker said he was told there was no more work and received no notice or holiday pay. The officer found he had been dismissed without proper procedures. The holiday-pay award was based on an estimate because the evidence was vague and no records were produced.
