WRC rejects technician’s unfair dismissal claim after Saturday work refusal

By Saoirse Doyle

Workplace Relations Commission ·

The Workplace Relations Commission found a technician’s unfair dismissal claim was not well founded in a decision dated 1 August 2017. The technician said a manager had promised there would be no Saturday work after a company takeover; the employer said a meeting referred only to an initial slowdown. The WRC found the technician’s original contract expressly included Saturday work and that it remained a contractual requirement after the takeover. It did not accept that the 2013 meeting abolished Saturday work, and found the technician’s interpretation was not shared by colleagues who attended. The WRC also found that fair procedures had been followed and that the dismissal decision was not rushed. The technician’s working-time, wages and employment-information complaints were withdrawn at the hearing.
