WRC awards €7,500 after finding product development assistant unfairly dismissed

By Aoife Loughran

Workplace Relations Commission ·

The WRC found that a product development assistant was unfairly dismissed and awarded her €7,500, after finding she contributed 50% to her dismissal. It also awarded her €557.69 in minimum notice pay. The decision was dated 8 November 2017.

The assistant said she was dismissed without a fair chance to respond. A food company said it dismissed her for insubordination and failing to follow urgent costing instructions. The adjudicator found she had avoided follow-up calls, but also found major procedural failings: no investigation, inadequate notice of the meeting, no chance to be represented, no impartial determination and no opportunity to improve. The officer found communication failures on both sides. The assistant’s working-time complaint was withdrawn.
