WRC rejects disability claims over withdrawn engineering job offer

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission found that a manufacturing company did not discriminate against a job applicant with a disability when it withdrew a conditional offer for a Product Design Engineer role. Adjudication officer Orla Jones dated the decision 11 August 2017.

The applicant said the company withdrew the offer after learning of his medical history. The company said the job involved heavy lifting, a medical opinion found him unfit for it, and he had not disclosed relevant information on a medical questionnaire.

The officer found that the applicant had a disability and that the company learned of it after his medical examination. She accepted the company’s evidence that it withdrew the offer for reasons other than discrimination. The officer also found that, in the circumstances, the company was not obliged to proceed with the offer. Both the discrimination and reasonable accommodation complaints failed.
